According to Notice No.279 issued by the State Intellectual Property Office (SIPO), there is a change in the Electronic Retrieval Method for priority documents between the SIPO and USPTO. For applications filed on or after September 1, 2018, electronic retrieval of priority documents will be managed by the WIPO Digital Access Service (DAS), and the Priority Document Exchange (PDX) will no longer be applied between the SIPO and USPTO due to some security reasons.

In view of the above, if you would like us to file a new application with the SIPO in China, claiming the benefit of a U.S. application, please also provide us with DAS code in the instruction letter, so that we can fill out the foreign priority information section in the Request of Digital Access Service for Priority Documents (DAS) and the SIPO will retrieve electronic priority document via WIPO DAS.

If no DAS code is submitted when filing, the DAS code or certified copies of U.S. Priority document should be supplemented within three months from the date of filing, which cannot be extended. If you miss such deadline, the Priority claim will be deemed not to have been made. However, the SIPO will issue a Notice on Deeming Not to Have Claimed the Right of Priority, a restoration of the Right of Priority can be filed within two months upon receipt of the Notice.
